Former Basketball Player Files Lawsuit Against TXST
One of the players dismissed from the team by new head coach Danny Kaspar. He was an off the bench player that averaged 2.2 ppg in his 2 yrs in the team.

Per our beat reporter, the main ponts of the lawsuit:

The complaint argues…
■No proper notice of scholarship cancellation was ever sent to Basil II.
■The NCAA does not allow scholarship cancellation at any time for athletic reasons.
■Basil II is lawfully entitled to an appeal hearing before any scholarship funding can be cut due to cancellation of scholarship.
■Basil II is lawfully entitled to medical bills being paid.
■Basil II was entitled to actual books and funding for a laptop.
■Basil II was entitled to file a complaint against the former coach without being retaliated against by TSU or the new coach.
■It is not in Basil Brown II’s best interest to transfer to another school.

I thought that, in the event that a new coach is hired, that all scholarships can be chosen to be revoked by the new coach in the same way that scholarships can still be honored by new coaches for recruits. The points say it all though.... he feels entitled to things and that is part of his problem.

Here's more of a summation of the complaint by our BCR staff. Some of it I just can't believe. Also, you will note our former coach is not named in the list of who this is being filed against yet, he is named in the complaint itself in reference to his injury.

This thing will get thrown out relatively quickly.... He is filing this in the wrong state (of which I am now a current resident and employee at a Texas State University System member institution) to be filing such heinous lawsuits. I may want to watch out though as he may try to file a defamation suit against me.

My guess is that eventually the school will agree to pay his medical bills and the rest of the suit will be thrown out.

Scholarships can't be revoked just because of a new coach. But scholarships are only a one year contracts that are renewable each year. So a school can choose not to renew a scholarship.

Scholarships can't be taken for performance. Its illegal. We see it happen but the player who scholarship is taken away doesn't usually take any action. How do I know? I coached football at the D-2 level. When we took over the program, we had several players who weren't good who were taking a bunch of our scholarship money. The only way we could get that money back was if they decided to leave the team. We couldn't just take it. So this player might win this.

I think the crux of it is that he has 22 hrs left to graduate and has a 3.0 GPA. It might be better to just pay for his classes (about 7K) than to hire a team of lawyers to fight it.

The problem there then becomes it could happen with other athletes.
