RE: Emoni is a Free Man
Emoni knew the gun was under the driver's seat if the vehicle and pled guilty to a misdemeanor of illegally transporting a gun. He's in Diversion program that calls for his pleas of guilty to be vacated and case dismissed if he gets in no further trouble during his probation period. Sounds like a fair and just result.

RE: Emoni is a Free Man
This case has been a learning process for me. I never gave much thought of what happens when cars are shared in the family and what can happen. This is a more unusual case, but what if 17 year old Suzy drives a car owned by her dad and dad has opioids and Viagra in the glove box.

She gets stopped for whatever and the glove box is searched. Suzy says those are not my drugs. I have no reason to use "an old man's drug."

Here again we are back to 'constructive possession' and common sense. Once again, common sense says, it's dad's car, the drugs are drugs he may use but she would not.

Welcome to the world of gray, not black and white. Can they prove the drugs are hers? No. Can they prove that the drugs are not? No.

BTW, ticket sales and television ratings will probably soar for the UofM game. The game now has national attention.

Everyone wins. Eastern handled the situation like an institution of higher learning with integrity--A RARITY, the police did a fine job and treated the young man with dignity and respect, I'm not a lawyer but judicial system played out in a fair manner, Emoni was polite, respectful, contrite, and compliant, hell, I have a ton of respect for him. I am not sure I would have handled that scary situation half as well at 18 years old! Everyone wins. Emoni has his mulligan, let's support him, let's be proud that EMU is a class institution. This is a great day, I am going to enjoy the hell out of this ride.

Agree 100%. This was a tough situation but everyone handled it very well. I really think a shout out to the sheriff's deputies. They were text book good. I'd give them very high marks for competency, judgement, etc. And the prosecutor's office got it right.

I hope a lot of people see the video. It is text book how for the accused to calmly handle a serious police incident.

Reading this is pretty eye-opening for me; Michigan right now is a trip. I never would have gotten into any trouble in the 90s if Michigan was as lax then as it is now.

None of this would currently fly in Texas.

That said, it’s Michigan - glad everything is over. Play ball.

An 18 year old kid gets caught smoking weed- and coincidentally his dad’s gun is in the car, and he gets charged with 2 felonies. You consider that “lax”?

He was driving high, and had weed in the car also.

All charges were dismissed. Yeah - that’s lax.
Weed is legal.
And doesn’t Texas allow open alcohol in cars?
Don’t like that he was driving stoned, but Americans drive intoxicated like it is a national pastime.

Legal to possess and use if you are 21 or older, Emoni is not.

RE: Emoni is a Free Man
It is unfortunate that a very poor decision by Emoni is now public and able for anyone to watch, I have gained a lot of respect for the kid in how he handled the situation after realizing he made mistakes. He treated the officers with respect, was honest and overall handled the arrest as good as you can expect. I hope this is a big wake up call, he learns and matures, and realizes that if focuses on basketball and avoids the distractions he has a bright future.

In the bodycam video you can see that the officers were very cool with the kid, even letting him use his phone. It also strikes me how scared he was. Just a reminder that he is a kid.

Finally, the man he was talking to on the phone (dad?) asked him if they "found my gun." Like I said before, it is not Emoni's gun.

Several comments:

1). This should be a training tape how traffic stops should be handled. The deputies were 100% professional. Emoni was a scared, cooperative 18 or 19 year old. I was VERY impressed how all handled it including his parents. The police read him his Miranda rights.

2). The info we developed was very good. We got the ownership of the gun and car correct. We had the parameters correct and did not buy into any story line that Emoni is a gangbanger or any other negative stereotype. He is basically a young college student.

3). I had heard he didn't have a DL (but I didn't post it).

4). And after all of the bad outcomes we see (including the kid shot recently while eating a hamburger at McDonalds) we should all be thankful that this has turned out as well as could be expected.

5). I may be a little more tolerant than some, but weed and cigarettes are as part of college aged as Boones farm was in my day. If we booted students who used weed
and cigarettes we'd probably have to close half of the dorms.

6). EMU handled it well. They did nothing which I find objectionable. As I had indicated, if the case would have dragged on I would have thought Wetherbee and Dr. Smith could have reviewed the suspension from athletics based on discovery. Based on the police tape, I'd let him practice. Obviously the case did not get to the discovery phase (with the reduced charges).

And I also hope that people understand that not all law enforcement officers have agendas.

And I say that as someone who isn’t particularly fond of the police…

I was definitely wrong about the racial profiling based search. In the video, Emoni literally suggested/offered the search.

That said, I am speaking as someone who does value cops- they have important and difficult jobs. But there are problems with police prejudice- this just happens to not be one of those cases.

Oh so we are no longer Fing everything associated with the Washtenaw County ?

No I am still there- just down a notch. I am just saying the search wasn’t motivated by racial prejudice. But the cops and DA still charged and pursued 2 trumped up felonies instead of a couple misdemeanors that actually fit this situation. I still don’t think this was handled appropriately. But time to move on…

Are you still wildly speculating on the what horrendous crimes Emoni could be plotting??

“No” on the open container question.

I agree with Eagle King’s and BobWickersham’s posts above regarding how well Emoni conducted himself in this arrest- gives you more respect for Emoni the young man. And agree with Nickle’s post with how frail Emoni was during the arrest- it humanizes him and makes him more relatable.

Emoni gets a lot of unfair criticism in the public arena from the press to all the all the social media know-nothings. This case was unfortunate and I am sure is embarrassing to the poor kid to have those videos plastered permanently all over the internet (not necessarily embarrassing for the mistakes he made, but rather because nobody ever wants to be seen crying). I am so glad my own “youthful indiscretions” remain silent as they are of no interest to anybody. Emoni is not afforded this, and I sympathize with him. But in the end, this unfortunate affair is going to be something Emoni can grow and learn from. And I think it is going to help with his public image (not that that should matter).

The maximum amount of pot a Michigan adult can possess for personal use is 2.5 ounces. Emonis had 4 ounces. Remind me again how unfair the police were again.

Because that would be a misdemeanor (I am assuming), not a felony. This is the same debate/arguments… but it is over now. Time to move on.

According to the video and police report, Bates admitted to law enforcement he had marijuana after officers mentioned the odor coming from the car.

"Here’s the issue, I smell weed coming from this car right now," video showed one deputy said to Bates.

"I just left my cousin's house," Bates responded. "I just smoked."

"OK, how much weed is in the car right now?" the deputy asked.

"It's right there," Bates replied, pointing to a bag on the ground.

At that point, the officer told Bates he now had probable cause to search the car and asked Bates to step out of he vehicle. When the officer first approached the vehicle, he asked Bates if there were any guns or drugs in the car. Bates then said no.

When Bates exited the car, he raised his hands in the air and said: "I’m not going to lie sir, you might as well just (handcuff) me up right now." He then told the officer there was a gun in the car.

https://www.freep.com/story/sports/colle...560865007/

So he plead guilty to a lesser charge and enters a diversion program. Hopefully he gets better guidance on personal decision making.
A guy like Stan Heath about this might provide the guidance that the kid needs. He may lack the maturity to go to the NBA next year and would be better off staying at EMU for at least two seasons. Not about the basketball but about the personal growth.

Agreed. He also would have been better off staying at Lincoln for at least another season as well.

You saw the video, this is a freaking HS kid who was fast tracked from ninth grade to Memphis in far too short of time. He does not have the personal skills or experience to cope with such a situation he encountered.

You clearly have a problem with the young man. Do yourself a favor, sit this basketball season out, come back fresh next year. Don't tear yourself up.

Also, viewing the infusion of both new players and returnees alike. Should be fun basketball for both the players and EMU fans.
