So he plead guilty to a lesser charge and enters a diversion program. Hopefully he gets better guidance on personal decision making.
A guy like Stan Heath about this might provide the guidance that the kid needs. He may lack the maturity to go to the NBA next year and would be better off staying at EMU for at least two seasons. Not about the basketball but about the personal growth.

Reading this is pretty eye-opening for me; Michigan right now is a trip. I never would have gotten into any trouble in the 90s if Michigan was as lax then as it is now.

None of this would currently fly in Texas.

In the bodycam video you can see that the officers were very cool with the kid, even letting him use his phone. It also strikes me how scared he was. Just a reminder that he is a kid.

Finally, the man he was talking to on the phone (dad?) asked him if they "found my gun." Like I said before, it is not Emoni's gun.

1). This should be a training tape how traffic stops should be handled. The deputies were 100% professional. Emoni was a scared, cooperative 18 or 19 year old. I was VERY impressed how all handled it including his parents. The police read him his Miranda rights.

2). The info we developed was very good. We got the ownership of the gun and car correct. We had the parameters correct and did not buy into any story line that Emoni is a gangbanger or any other negative stereotype. He is basically a young college student.

3). I had heard he didn't have a DL (but I didn't post it).

4). And after all of the bad outcomes we see (including the kid shot recently while eating a hamburger at McDonalds) we should all be thankful that this has turned out as well as could be expected.

5). I may be a little more tolerant than some, but weed and cigarettes are as part of college aged as Boones farm was in my day. If we booted students who used weed
and cigarettes we'd probably have to close half of the dorms.

6). EMU handled it well. They did nothing which I find objectionable. As I had indicated, if the case would have dragged on I would have thought Wetherbee and Dr. Smith could have reviewed the suspension from athletics based on discovery. Based on the police tape, I'd let him practice. Obviously the case did not get to the discovery phase (with the reduced charges).

An 18 year old kid gets caught smoking weed- and coincidentally his dad’s gun is in the car, and he gets charged with 2 felonies. You consider that “lax”?

I was definitely wrong about the racial profiling based search. In the video, Emoni literally suggested/offered the search.

That said, I am speaking as someone who does value cops- they have important and difficult jobs. But there are problems with police prejudice- this just happens to not be one of those cases.

Owning a gun with a scratched off # is pretty damn stupid. Leaving it unsecured in the car when you give your 18 year old the keys for a night out is about as intelligent as a baked potato. Emoni isn't the only one lacking in maturity.

First of all, touché. You were right from the beginning.

Second of all, that video made my heart melt for the kid. He does have a lot of maturing to do. NOT that he has problem behavior but rather he is still so young and naive.

Hard to escape what appears to be the facts from the outset. That the police had no evidence that Emoni had altered the gun's identification, yet they charged him with the felony of altering the pistol.

His father saying on the phone that "did they find my gun" is evidence that Emoni may have known the gun was in the car, and his subsequent expected plea to illegally transporting a gun is an admission on his part that he knew the gun was in the car.

His lawyer did a good job, for if he complies with the diversion program, conviction on that charge will be dismissed.

I just went back to read some of the comments you are referring to. Indeed, they are harsh. I agree with you that some just want to revel in the failure of an otherwise successful person- a very ugly part of human nature. But I also suspect many of these comments are from “but*-hurt” MSU fans that resent him de-committing and others are arrogant UM fans that are incredulous he passed up on UM for Eastern.

Emoni might not have known there was a gun in the car until he reached into the glove compartment to find the registration. If he knew there was an illegal gun in there, he probably shouldn’t have been driving on a permit only and while under the influence.

That said, I don’t think Emoni (or anybody) should be driving under the influence. So I am glad he is pleading guilty to some misdemeanor in this case, but I think it was the wrong misdemeanor. The older I get the more I regret my own such “youthful indiscretions” to borrow George W’s term. A non-registered gun for self-protection is a victimless crime if a crime at all. But DUI puts others in danger.

And doesn’t Texas allow open alcohol in cars?
Don’t like that he was driving stoned, but Americans drive intoxicated like it is a national pastime.

Bates was driving a black Mitsubishi Outlander with a Tennessee license plate, registered to a business "BMGT LLC." Records indicate that business is connected to an address located in Memphis, Tennessee.

Video showed Bates was allowed to call his parents in the back of the patrol vehicle as he was taken to the station, and after his mother and father consoled him, a discussion of the car did come up.

"When people ask about the vehicle, it’s a company vehicle that’s in my name," a male voice said on the phone. "But … don’t answer (expletive)."
