Would we even be having this discussion if a woman athlete or third string safety was in the same circumstances and suspended? Would we be advocating letting them play right now. I don't think so. Let's make sure we under understand the word ENTITLEMENT as well.
ENTITLEMENT? Just the opposite happened here. Would a WHITE woman athlete or a WHITE third string safety's car have been searched in the first place? This is total BS and you either know it or you are part of the problem.

Look, either Emoni or his familiars probably should not have had a gun in the car, especially one that was not registered. I hate guns and most people I am familiar with hate guns too. But I know some (very close) people who value guns for protection and keep them in places I consider ludicrous. I don’t judge them in any way. My views are not right while their’s are not wrong. We just have different views.

What is different in this case? The gun was not properly registered- period. But given how the criminal justice system works towards Black men (especially young black men), I would not want to register the gun either. The handling of this case with the absurd vehicle search, trumped up charges, and hard-pressing prosecution is a case in point. I have no judgement against Emoni or his familiars on this.

People are using this situation to project their own opinions on a circumstance we know absolutely nothing about. We know nothing about the evidence surrounding the stop. There is a legal process that has to play out, but everyone wants to skip it because it involves someone who can play basketball. This is despicable. Asking for the President to pardon him, etc. Ridiculous. Some of you are parodies of the stereotypical win at all costs college sports fans. Speaking for myself, it has NOTHING to do with winning or losing. Even with Emoni Bates, Eastern is picked for middle of the pack in the MAC. This transcends sports. You stated your opinion and I'll go ahead and disagree with it. Thanks.

You are an educated person. The are two type of errors in research and also in this type of case.

One is the 'false positive' which would be saying some has Covid, a STD, etc. when they in fact do not, or in this case where he had possession of concealed weapon when in fact it was not his.

The other is the opposite saying one someone doesn't have Covid, STD, etc. when in fact they do and in this case, he did not have possession of concealed weapons when in fact he does.

Both are serious problems in medicine, jurisprudence, etc. Both medicine and the law spend untold resources trying to avoid these problems because BOTH are very problematic.

The most obvious is the person serving a long sentence and get cleared by DNA after his or her life has been ruined.

But too many, esp. poor, minorities, etc. get wrongfully convicted because they do not have the resources to prevent the second type of error in the legal system, an innocent person is found guilty.

We seem to be ignoring that Emoni faces significant legal jeopardy, more than simply missing some basketball games. He was charged with two felony counts. That's as serious as a heart attack. A miscarriage of justice would go down in the criminal justice text books.

Sorry, but I don't blame anyone for being really concerned about charging two felonies on something which seems dubious as we have said, this case seems as clear as a polluted lake.

I have to say, you can disagree with Holy about him thinking this is a win at all case attitude, but he does have a point about the police aspect.

Apparently, to some of you, talking about theories or hypothesizing about what may have happened is a big no-no without having any facts (which I can understand). Yet, then there is no issue with claiming with certainty that this was a racist, bogus stop/search that wouldn't have happened if Emoni were white...again that is a theory until we know what actually happened. It's a decent theory since things like that have obviously happened before, but it's still just a theory at this point. Bob, I believe it was you who asked in another post would a white safety or white female be stopped and searched...maybe. White people do get pulled over for rather "normal" offenses and searched. Correct me if I'm wrong, but to this point I don't believe Bates nor his attorney have said anything about race playing a part in this case.

My view is in an open forum people can say or theorize what they'd like, but at least be consistent with what your standards are.

I agree, nothing seems to make a lot of sense. Like the whole theory about it being his Dad car and he was going to turn himself in...that seemed far-fetched to me. Thinking through possible scenarios, none of them make a lot of sense.

One great point you made is about people not having resources, hopefully that is something Emoni does have. Obviously I don't know the Bates personal financial situation, but with NIL and all that hopefully they have some money to cover cost of things if need be.

One thing that doesn't make sense to me is the car. Bate's attorney has said it wasn't his car, I understand if the gun isn't registered it probably couldn't be traced, but shouldn't they pretty easily be able to figure out who the car belongs to by figuring out who it was registered to, or Emoni just saying "Hey it's Joe Blow's car" which should lead them towards the answer of who the gun belongs to? Any law-types know if something like that could be going on behind the scenes?

To the contrary, we have most of the facts already. He was pulled over for failing to stop at a stop sign-> his car was searched-> a gun was found with allegedly tampered serial number. That is what the Sherif spokesman said and that is what the court records say. No other charges- no obstruction, no resistance, no pursuit of a crime- nothing.

Some of you assuming something else must have happened in order to prompt the search is “gross” in itself. If you think owning a gun for protection is wrong, then I am actually with you. I just don’t think it is a crime, and something I know others do.

A kid who was so supportive to his community and now to our alma mater deserves our support in return. He should not be treated like he is by the local cops/legal system- this is so serious both legally and for his reputation. That is what is really “gross”… I am sorry if you or anyone else feel offended that I am claiming some nameless cop was racist and that there is unfair prejudice in the legal system. But it happens to be the truth and a real problem.

Good points. Some info someone shared with me might suggest (and suggest is the word) that Emoni may not even own a car.

So we are back to square one: We don't know whose car (seems more unlikely not Emoni's) and whose gun.

I'm with you on that Ramy. We disagree on the gun aspect, I personally own a legal gun but I don't carry it. My wife and I are the only people in the world who know where it is and the code to open the safe. I just feel I want to have it as a way to protect my family. I certainly can understand and respect your view of it too. I can also understand why sometime like Emoni would want a gun for protection (fame, money, etc.).

What makes me really scratch my head about the situation (like I posted above) is why can't they easily trace the car that should lead to the gun? If you believe Emoni's attorney (which I do) it isn't his gun, so who's car was it?

I wonder if they could be in a stalemate? I'm driving your car, there is a unregistered gun so I say well it must be Ramy's because it's not mine. You claim yeah it's my car but that's not mine, it's gotta be Sellers. That seems hard to prove either one.

Yeah, I'm close to you on the last paragraph.

The officer says, "I found a gun." The prosecutor says, "whose gun?" Officer, "don't know but I know who was driving the car."

So they have a 'crime' but not sure who to charge? Driver? Well, that's pretty easy.

I'm going, beyond, well beyond, my knowledge of the criminal justice system, but if it is really a felony (as charged), it probably should not have been charged and gone to a grand jury after a thorough investigation.

I'll repeat what I've posted before: There are NO winners in this case. Emoni doesn't look good. His father, probably not. The criminal justice system in Washtenaw County, lot of questions to answer.

He should not be treated like he is by the local cops/legal system- this is so serious both legally and for his reputation. That is what is really “gross”… I am sorry if you or anyone else feel offended that I am claiming some nameless cop was racist and that there is unfair prejudice in the legal system. But it happens to be the truth and a real problem.

My wife and I are the only people in the world who know where it is and the code to open the safe. I just feel I want to have it as a way to protect my family. I certainly can understand and respect your view of it too. I can also understand why sometime like Emoni would want a gun for protection (fame, money, etc.).

What makes me really scratch my head about the situation (like I posted above) is why can't they easily trace the car that should lead to the gun? If you believe Emoni's attorney (which I do) it isn't his gun, so who's car was it?

The lawyer said, “it was a borrowed car”. I am assuming it is a family member’s car- dad, brother, etc. The car probably is easily identifiable to that person, but they don’t want to come right out and say it as it would transfer the legal responsibility to that person. For EMU fans that would be ideal to do so that he gets to play in the UM game, but to the Bates family as a whole that still has lots of consequences. So better to wait a few weeks to get this case dropped altogether.

My whole point of gun ownership, is that I hate them but everyone has a different perspective on need and how to handle them safely. I am not judging that or making a political statement- just personal perspective. But I am saying, I don’t fear or judge or whatever Emoni because he or a relative owns a gun (registered or not makes no difference to me. Glove compartment or safe, makes no difference to me). Nor am I embarrassed by association of a “gun owner” being on my alma mater’s basketball team. Just reinstate him.

Legal guns and legal gun owners don't own or have guns where the identifying marks is serial number have been altered. This is done by individuals who don't want the gun traced. You know like criminals.

I can recall one poster saying Bates dad was not a good individual and questioning his father's motives. Then Bates signed with EMU and that criticism disappeared. Hm.

Yeah reality bites. I view athletes as the same as the rest of us ordinary mortals. Some folks are talented at cooking. Some at bagging groceries. Some are talented athletes. But the cops or athletes or anyone else is not above the law. Cops make mistakes. Athletes make mistakes. In this case our legal system will hear both sides. Hopefully justice will prevail.
