From Mackin's point of view, this whole situation is just about to the point (if it's not already) where he will HAVE to speak up and set the record straight on a variety of matters, if he ever wants to have any kind of career in collegiate athletic administration again.

So what if Mackin decides to speak up now? Are his words going to suddenly become accepted as gospel?

Watts has been quoted as saying that without football messing up the school's finances, the remaining athletic programs will be more competitive in C-USA. As things stand today with the existing C-USA bylaws requiring FBS football, we will have as good a chance to win the SEC basketball tournament next year as to win the C-USA tournament since we won't be in either one. Is he going to admit to abysmal ignorance of C-USA rules and bylaws too?

No, but his words could -- emphasizing, COULD -- shed light on 3 critical questions:
1. Who made the decision to terminate UAB football?
(1-a. Who was made aware of that decision?)
2. When was that decision made?
3. What was the reason for making that decision?

#1- we already feel sure about who made the decision - and it was NOT Dr. Watts acting alone.
#2- depends on what stage in the process you want. The actual decision was made a decade or more ago but had to wait for a compliant UAB President to be carried out.
#3- "Thou shalt have no football program (in the UA system) before OUR Crimson Tide!"

The problem with any NDA Brian signed is that standard non-disclosure boilerplate stipulates that if a breach in information occurs, Brian could be on the hook for unspecified compensatory damages, plus any Machine attorneys' fees. In addition, most NDAs state that neither party is generally allowed to acknowledge its very existence.

The one exception, as stated here, is if Brian were questioned by a government or regulatory authority.

What about non-dispargement? Ray is certainly disparging the hell out of Mackin and Margison.

I respect your opinion and my perception of Mackin has changed for the better thanks to how a lot of the people on the forum talk about him, but I disagree.

It would be good for UAB if he shared his story.

I believe people mention non disclosure agreements because staying silent in the situation just doesn't make sense, especially when Dr. Watts is positioning him under the bus. I'm forced to think he's legally obligated not to say anything because someone that fought as hard and as long as he did for these teams just to shut it down without even talking to anyone is crazy.

His silence doesn't do anyone any good. The only reason we have some footholds now in regards to our efforts is because people spoke up when they noticed things. And, career wise, his silence isn't working to change the narrative.
