There is nothing from stopping every speaker from saying a prayer before they speak.

However, I think the judge is wrong on the basis of the law as I interpret it.

The "separation of church and state" is merely to prevent the government from establishing one state religion. I see nothing in a prayer said by a speaker, regardless of who they were praying too, that would indicate that the government (the school) was endorsing or establishing a preferred religion.

Fact is, I agree with you, and state-sanctioned prayer to any particular deity makes me prickly.

I just don't buy the "irreparable harm" foolishness.

Yeah...I don't buy the harm either. Must be afraid it might actually have a positive effect on him...as studies show it usually does.

It might be a good idea or a bad idea, depending on the circumstances. But I would never try to claim the Constitution forbids it.

US 5th Circuit Court of Appeals has visited this issue at least 10 times before. It seems to come up again and again this time of the year.

The case law is pretty straight forward, and the District Court Judge that entered the Order had to know he would be reversed on Appeal.
