Well we don't know that JMU would be dropped sports to make a jump. And ODU would be (and has been) a rival for JMU. Of course, if CUSA would've offered JMU, they'd already be there.
Your first two points are certainly correct, and obviously difficult to answer. If they weren't, then more would've jumped.

More likely a systemic bias against a private religious school in the move-up rules. I think its pretty clear there is.
Note that systemic bias does not imply hate, or bigotry.
I think the NCAA simply didn't want to fight it. If they did, they'd simply change the rules to state...."no FBS institution can have policies that discriminate in participation or employment on the basis of sexual orientation, marital status, or religion". Then LU (and Baylor and BYU) could choose to comply with it or not. Both BYU and BU would comply. Every other FBS school is in compliance, including religious schools. LU wouldn't be successful if they sued the NCAA over that.
That being said, that the whole conference sponsorship rule was harder to justify on the basis of PRIVATE (regardless of institution) schools. The Belt has a stated preference against private schools. CUSA has never sponsored a move up. The MAC hasn't either.
I think people are getting stuck on the Legal office aspect instead of the the NCAA Division Football Oversight Committee feedback. My point this may be the first start in getting rid of the conference rule. Schools will still need the money. In addition, people are looking at existing schools moving up. Remember Wichita St wants to start football back up and could jump straight to FBS as an independent following the USF model.

There is a thread in the verbal insult section about a year ago that NoDak reported that Liberty was going get to FBS in a few months. If that is the case? WAC FBS could be in the cards?

Only 6 schools that can make an automatic case for FBS. Attendance is on the decline nationally so its becoming tougher to do 15,000.
The loss of these schools of course would bring down averages and general fan interest in their conferences.
Im not sure that rule would hold up either. It seems it would be easy to demonstrate several fbs school do not maintain that level of attendance. And especially the fact that ccu was allowed to join with a stadium that doesn hold 15k.
This is a non-factor. Many FCS to FBS move ups increased stadium capacity after getting the invite. Coastal will have a +/- 21,000 seat stadium by the time they are full FBS members.
Thats my point exactly, to join fbs they need only upgrade a HS size stadium to an fcs size stadium.

JMU can't drop sports.
we are already at the minimum of 6 men's sports required to be D1 and if we dropped any women's sports we would fall out of compliance with Title IX

That was when this whole board thought I was insane and not prophetic. An FBS WAC will be reborn, with schools that need each other for scheduling. Liberty does not need an FBS conference to schedule. Liberty could have bought an FBS invite from the WAC for what they offered to the Sun Belt. A waiver is far cheaper.

Fair enough. Though oddly on the men's side you have tennis and soccer, while no XC/indoor/outdoor track. Not that tennis and soccer are expensive sports, but would think any/every school would have the full slate of the three "separate" sports on the track side for easy compliance.

Very famous alumni could help out. Kenny Chesney is an alum of East Tennessee State. He helped raised funds to bring football back at the school. If East Tennessee State wants to get back into the FBS? Kenny could help raise funds for that to happen. Any of these schools could get the help to get their teams up yo FBS. Jacksonville State, Lamar, James Madison, Delaware, North Dakota State and so forth. They have more famous alums than some at the FBS level.
