RE: Emoni is a Free Man
Posting this from the SI article. What I find A Maize ing is the similarities how the Emoni and Mazi instances happened, etc. etc.
The only difference I could ascertain is: Mazi was driving his car and in the process of obtaining a concealed permit. Emoni was driving his father's car and the weapon was not his. Rest of the case could have been 'copied and pasted.'
Simple: The simple case was Emoni's. Mazi's more complicated. The emphasis below is MINE."
"“This is Mr. Smith’s first contact with the law,” Shea said. “This incident arose out of a traffic stop at around 9 o’clock in the morning -- maybe I’m a little off on the exact time, but it was in the morning on a Friday.
“He was asked whether there was a weapon in the car. He was honest. He was forthright. He was completely cooperative. Ironically, he was in the midst of obtaining his CPL. He had not yet completely obtained it. He does have it now, which is even more ironic. But he was in the process, and I say that not to try to convey anything other than he was trying to be responsible, and he completed that process.

I'd say a pretty notable difference was that Emoni was also driving under the influence of marijuana. There's no mention of that being part of the case in the Smith article.

One of the guns had removed serial numbers. That’s a pretty big freaking difference between the two cases.
Some of you need to stop talking about this kind of stuff.

Dan, you make a great point. EMU and U-M have distinctly different positions of influence within Washtenaw County.
U-M built a video board in front of the Big House that extremely violated Ann Arbor city code and did not attempt to secure approval before doing so. When A2 govt complained, U-M explained that as a state agency, they are exempt from local regulation and advised A2 city council to "pound sand", so to speak. M also bought the nearby Fingerle Lumber yard that is in a flood plain, thus subject to city restrictions on development. No problem for Blue, they can do whatever they want at the property.
EMU, by contrast, had to make a presentation to Ypsilanti Township and secure approval before initiating construction on the Eagle Crest new building project.
John Shea, the attorney representing Mazi Smith, is seasoned at high-profile cases. He represented Kwami Kilpatrick's father and I suspect that he is either working pro-bono here for U-M or his legal fees are being paid by boosters. I doubt Emoni had the same resource opportunity.

The parallels are outstanding, but processing 180 degrees different.
The one thing I haven't heard is if the gun was loaded. Having an unloaded gun in the vehicle without a CPL, while still against the law, could be a case of Smith just transporting the gun improperly. However, a loaded gun implies "at-the-ready", for which the intention is significantly greater than simple transport.
In his editorial about the incident, Mitch Albom wrote:
"Why exactly does a college senior in Ann Arbor — especially one not likely to be harassed — need a gun? And don’t U-M employees like Manuel and Harbaugh have an obligation to at least acknowledge that the school has a rule that prohibits guns, even those with CCWs, anywhere on campus property?"
"Where was Smith planning on carrying that weapon? He couldn’t legally park at school, go to class or even drive to practice with it. Doesn’t that warrant a comment?"
I have yet to hear any UM authority even begin to address those questions.

Yeah, why does a UofM lineman need a weapon. I may need a weapon if I was ever near him. I can bench press my coffee mug 20 times at breakfast before getting tired and quitting (or maybe because the cup is empty).
Dennis, my cup has too little coffee. Maybe Mazi has too much NIL.

Wow...I have a CPL and I carry...but nowhere near that much ammo. That's 69 rounds he was carrying. If you are carrying for self-defense and you feel you need 70 rounds (assuming he had one in the chamber), you should probably rethink where you are heading.

From Grand Rapids, not inner-city Detroit or Chicago and now living in Ann Arbor. I'm with you, I don't see the purpose here.

From the time charges were filed to the time it was in court and the plea bargain accepted seemed to move awfully fast. Didn't Emoni's case take at least a month or so before they got to this point? Perhaps Savit wanted this cleared before the TCU game.

Yeah. And I thought Emoni's attorney tried to speed up the process so it didn't drag on as they can.
I think the two cases are about as similar as they could be. The only real difference I remember is that Emoni has a car/pistol not his but Smith had his own pistol/car.
Neither had a valid driver's license, if I recollect correctly.

One was high. One had the serial number filed off the gun.

Great freaking point, but as a resident of Ann Arbor, I'm not even shocked a little bit.

I am almost certain NO ONE on the UM boards are questioning Mazi Smith over this. Or questioning whether or not he should be on the team. It’s probably a chorus of excuses and support for Mazi Smith and the handling of the situation by UM administration.
Meanwhile on the EMU board, some posters are still trying to scrutinize Emoni Bates….
