Before this legal kerfuffle the SBC 3 seemed to be happy to pay an out of pocket exit fee of some sort. After this, I don’t think they will pay anything. And given their legal victories it seems like they won’t be obligated to.

C-USA might be able to withhold some distributions and payments for this year. But that’s it.

Well, I don’t know about zero, but when I voted for the 1-1.5 million fee, I was counting the forfeited media payments. I think that on top of that it will be close to the 1/2 million range that most people here are voting for in the poll.

Might be able to withhold distributions? Buddy, that is happening no matter what. Even the biggest SB3 homer isn’t denying that. Legal victories? They got a two week restraining order from courts filled with their alumni, not a landmark victory lol

In each of those cases so far, CUSA would have to prove how releasing USM and Marshall damage the conference and it will be decided if arbitration can be used or not with the schools claiming immunity.

If a judge rules that no arbitration is needed, CUSA can't file an injunction to keep the schools in CUSA, meaning they can move forward to the SBC this summer and they can either sit down and discuss exit terms ($$) or they can file an appeal. By time an appeal would all shake out USM, Marshall, and ODU could be in SBC already.

Yes, and I suspect that is the plan.
CUSA will withhold all payments and distributed monies otherwise due its members. That was always absolute.
However, if, as has been reported, there is no specificity as to exit fees in the CUSA bylaws, then the SBC3 could come out of all of this owing nothing more than legal fees IF they can stall the arbitration issue.
Any claimed "damages" incurred by CUSA as a result would be separate, after-the-fact litigation that might take some time, and would likely not be resolved until AFTER the SBC3 were already fully entered into the SBC.

Like I said, we’ve been doing it for years. Making jokes about our crappy leadership and worthless TV deal was something we bonded over just a few years ago. We were all in it together. I’m not trying to rub anybody’s face in it and truly wish everyone well but I’m not going to suddenly pretend a piece of crap is anything but. I hope CUSA 4.0 does well.

The reason why I said “might” is because I’m not sure when and how money is distributed. There’s a chance part of this year’s distribution may have already been distributed to the SBC 3 and C-USA might have a hard time getting it back.

Yes, they got a two week restraining order. But the fact that they were able to get this tells me these battles will be fought in state courts, not in Texas courts or arbitration. That’s a worst case scenario for C-USA… buddy.
