The buyout to leave C-USA is the forfeiture of two years of conference payouts. But C-USA has maintained the schools still have a contractual commitment and the early departure of the schools could lead to damages through less inventory for its media rights deals.

Why do these schools want to leave early?
Chris Vannini, national college football writer: Most conference realignment moves are still more than a year away. Texas and Oklahoma aren’t supposed to leave for the SEC until 2025. But we’ve seen quicker movement at the lower levels because the cost is lower. The actual cost to leave C-USA is forfeiting future money, so if you’re not getting it, why not leave right away?

C-USA argues that the schools are still contracted to fulfill obligations that come with being a member, like playing games on C-USA media rights deals. Those schools were hoping to negotiate some kind of additional fee to get out, but they say C-USA won’t even have the conversation. So now they’re forcing their way out to create that conversation.

What happens next?
Vannini: It became clear weeks ago that lawyers would have to hash this out. But the schools felt they had no choice but to spill this into the public now, which will make this even more expensive for those lawyers. A source told The Athletic the Sun Belt was not involved in this announcement and the league has just been waiting for those schools to get out of their obligations. The Sun Belt typically releases its football schedules in early March.

We’ve seen recent decisions by conferences at the non-FBS level to ban early departing members from conference championships (the CAA with JMU, America East with Stony Brook and the Horizon with UIC), but a source told The Athletic that C-USA does not have such a bylaw. Still, this breakup is messy and could drag on. As is typically the case, the lawyers are the biggest winners

...seems like the last round of the AAC teams which moved up from CUSA had minimal fees or whatever... they may have well hung around an extra year, tho...

None of the past CUSA departures from the 1.0 or 2.0 era left as early as the SBC 3 tried to do. I can't recall if the notice period has always been 14 months, but if so, all the past teams have met it. Everyone from Cincinnati, Louisville, USF, TCU, army, UCF, Houston, SMU, Memphis, ECU, Tulsa, and Tulane.

Of all those past teams, Tulsa left with the least amount of notice: 15 months. The SBC 3 are leaving with 8 months notice. So on one hand CUSA is definitely negotiating in bad faith by not even going to the table with these teams to talk, but the SBC 3 fans online have been perpetuating some weird victim complex that CUSA never caused as much issue to past teams, ignoring that all the others met the required notice period.

In the first wave of departures, some schools negotiated down their exit fees by playing games against the c-usa teams they were leaving behind. I don’t think that will be in play this time as there isn’t anywhere near the same value. The departing schools also don’t have a stash of ncaa units they can leave behind.

All of this is just posturing over the money.

I've seen multiple people mention, here and on Facebook or Twitter, that we lost two home games and don't know how we will replace them. Well, a few of the conference schools that are left lost two road games, so it shouldn't be hard to make them match. No doubt Southern Miss and Marshall would have been more attractive home games than FIU and Charlotte, but it really won't be that difficult for the league to reshuffle the deck and put together schedules for 11 teams.

As has been stated, all of this is posturing right now, and lawyering for the sake of financial settlements.

I only wish Marshall had somehow pulled out of the league on Jan. 1 so we could have avoided that basketball debacle at their place a few weeks back.

Question: If the only exit fee is forfeiting 2 years of conference earnings and the teams leave early, how would 2022-23 earnings be considered the 2nd year forfeited? Those schools wouldn't be entitled to that disbursement by leaving early. It seems to me that if they leave early, they only actually have forfeited the 2021-22 monies and should have to give back money they already received for 2020-21.

I suspect C-USA will file suit against the SBC3 in Federal Court shortly...seeking an injunction to bind them to their contract and to prevent their playing in any other conference until 7/1/2023. Of course the Conference leadership doesn't have the sense God gave the lowliest vertebrates...so they might continue their passive stance...only issuing whiny press releases.

I agree on both sides. It's not that big of a deal, but C-USA will find a way to mess it up. I really believe you give any of us a couple of hours and a legal pad and pen (and maybe internet access) and we could work out a schedule for the remaining 11 conference schools.

USM, Marshall and ODU leaving early... So what is the gain? Why the rush? I think that the Sun Belt is intentionally trying to posture for something, but I don't know what that something is...

...not to be contrary 03-drunk - but I don't see the SBC EVER being at AAC level... they've had some good football the last few seasons (but somewhat 'muted' by the pandemic season where a third of the programs in Div.1 either weren't playing or started late, and cancellations were rampant), but basketball is not even close... over time, perhaps... football definitely has some strong potential.

...for some reason, folks love the MWC as the 'new P6'... maybe, but... I don't see anything football-wise out there which is drastically that much better than anything the AAC, SBC, or even the current CUSA has been doing... they DO beat up on the PAC12, but... that 'P5' conference is pretty weak in football currently...
