I thought there was some rule that FCS move-ups needed a conference invite. Liberty was the exception. Im not sure NDSU or another move-up would be allowed to move as an independent.
I doubt the NCAA really has much say in the matter now. They granted Liberty a waiver, so I don’t see how they could refuse anyone else.

Pretty easily if they wanted to. Liberty had all the qualifications to be a successful FBS program, but no one wanted to take them. They had the money, the facilities, the location, the support. But still no one wanted them. It was clear that the reason was Liberty's religious views. Liberty made a case to the NCAA that the only reason they couldn't get an invite was religious discrimination and that they would file a lawsuit if the NCAA didn't grant a waiver. Don't see how any of that applies to NDSU.
*FYI, I don't particularly like Liberty or the brand of Christianity they and their founder push. If my school was in a conference they were courting, I wouldn't want them in either. But I can't begrudge them pushing the NCAA for a waiver.

NDSU could easily make a case that they could be a viable member of FBS. That being said, if they don’t have the money to sustain as and independent, then that is a different story.
