AState Athletics: "North texas has still not paid Grant McCasland's buyout

Per his contract, UNT had 30 days to pay us the 500K buyout. That deadline was Monday.

AState has turned the matter over to legal counsel.

There was a comment on the C-USA/Sun-Belt merger thread from a UNT fan stating that UNT was going to be investing more money in athletics facilities and coaches going forward.

I would think that failure to pay per a contract while investing more money somewhere else will result in punitive damages as well as what was due per the contract.

This whole McCasland situation is just a mess. He immediately tried to steal all our signees when he got there. (We managed to retain just one of them) and it looks like he even got a current player to follow him. There's been a lot of talk that the money for him was fronted by someone connected to McCasland's family, and that he basically wanted out of Jonesboro from the beginning.

He's quickly becoming the most unpopular former coach we've ever had, and that includes the cheating Hugh Freeze.

I would hope that the contract didn't specify arbitration as the only means for settling disputes. It would be helpful to have the force of the state behind the contract.

UNT's official response:

"No Worries, it's coming...we've got the money, we promise."

Side note...what the hell is that mascot in the photo on the website?

Doesn't McCasland owe the buyout?

The contract is with McCasland and not UNT right?

Contract names McCasland AND his future employer.

Contract cannot bind the future employer because they aren't a party to the contract but he does have to fork up the money or be at risk of garnishment or seizure of assets to pay the contract.

Wouldn't they become a party to the contract upon entering into a contract with the secondary party? Similar to a non-compete agreement.

Absolutely not. You can't become obligated to a contract that you never signed.

It would be up to McCasland to make sure his contract with UNT included the 500k check to stAte. And in the event of failure to pay on UNT's part, McCasland would be liable to pay the money out of his pocket because at the end of the day, HE and only HE had a valid and enforceable contract with stAte.

Now obviously that will never happen because he could then turn around and sue UNT, and that would not look good to the masses.

UNT will pay.

I've got to admit, the thread on this in their forum is hilarious. I tried to get this one off on the right foot with my "low budget" comment but folks are being to serious. The money will come. And we will recruit to replace all the players he stole from us. In a few years maybe we will be lucky enough to meet up and whip his ass.

It's a money-struggle to be in CUSA these days.

Anytime our board invades GoMeangreen, general hilarity ensues...

I like the greenies. Even went to a UNT-UL game at Fouts with Harry when I was working in Dallas one weekend. That got me free beer to watch some absolutely awful football.

I enjoy the way one side tried to spin this like "yea we showed them who is boss" or "we do things when we want to"

I wonder what the contractors on their (rumored) "soon to start" IPF will think about getting their checks "whenever they decide to pay"

I think the lack of any actual announcement and the fact that there was a struggle to pay $500,000 means the IPF is probably more green smoke than reality......kind of like the baseball program that is -> <- this close to starting for the last decade or so
