I dont believe its "vice-versa". Comey and the justice department NOT convening a grand jury back in July is nothing but pure coverup. Within a few hours they would have had an indictment. Comey HAD to do this now because:

1. The resignations of agents were piling up on his desk
2. He pre-maturely closed the investigation, but promised congress he would update them if anything else came to light.
3. He may be highly concerned that the podesta (or other) leaks will implicate himself or someone else at the FBI just like Kradick has been found working with the Clinton campaign.
4. The JD was refusing to grant his agents a warrant to search Anthony's PC
5. The JD is still blocking access to a grand jury.
