RE: OT: ODU Fraternity Suspended
That first amendment is a tricky thing. On a moral level, I agree with Tribal about the statements regarding freshmen girls. If I had been a parent of a first year female student, my instinctive reaction would have been to put the car in reverse and drive back home, and place said female student in sequestration for a year.
However, that would be overly protective and counter productive. Additionally, I feel that the price of functioning as an adult in a free society with protections for expression is exposure to rude, vulgar, offensive, tasteless, racist, and sexist statements, lyrics, movies, videos. Unfortunately, my opinion seems to be in the minority these days.
Nothing in the banners attempted to associate the statements of the relevant students with ODU, or official ODU policy. The statements, while suggestive of sophomoric fraternity behavior, did not in any way reference or suggest rape or sexual assault. Attempting to stifle vulgar, offensive, criminal, racist, or sexist behavior through official University policy is fundamentally distinct from attempting to stifle or punish vulgar, offensive, racist or sexist expression. Its a thin line, but a very important one, and I think in this case ODU would be overstepping that line by taking action against these students, in order to avoid any reputational risk. Policing what is at heart an example of bad taste is not, in my opinion, an appropriate exercise of University jurisdiction, particularly since the relevant conduct occurred off-campus.
And, in due fairness, while I felt the signs about dropping off freshmen girls were revolting, I had a bit of a chuckle about the "drop mom off too" sign. I suppose I felt that was more amusing, and I doubt any mothers were truly offended.
