Judge Rules Against the NCAA
Judge Rules Against the NCAA and calls them a cartel in the
OBannon Case.

a landmark decision, a federal judge ruled Friday that the NCAA is in violation of the nation's antitrust laws by restricting the compensation that major college football and men's basketball student-athletes can receive for use of their names, images and likenesses.

U.S. District Court Judge Claudia Wilken, in a 99-page decision that followed a contentious three-week trial in June, sided with a group of plaintiffs, led by former UCLA basketball player Ed O'Bannon, who sued the NCAA, claiming it violated antitrust laws by conspiring with the schools and conferences to block the athletes from getting a share of the revenues generated from the use of their images in broadcasts and video games.

"The Court finds that the challenged NCAA rules unreasonably restrain trade in the market for certain educational and athletic opportunities offered by NCAA Division I schools," Wilken wrote in issuing an injunction prohibiting the NCAA from enforcing its rules on money given to athletes when it comes to their names, images and likenesses.

Things are really going to change in the P-5 over the next year. Not just
the O'Bannon decision, but with the NCAA allowing players food anytime
Oklahoma is buying a food truck to feed players 24/7 at a cost of a
million dollars a year with operating costs.
In the G-5 UMass is cutting their scholarships to 82 to save the money for three
scholarships to pay for the autonomy extras.

As I'm skimming the decision, looks to me that the NCAA can cap compensation at $5k over current scholarship levels.

Only applies to football and men's basketball.
The liability for paying $5k to 98 players is $490,000

True but,
"The compensation will be paid into a trust fund. However, if a school does not try to sell anything with the players' names, images and likenesses, there will be no money to pay into the trust fund. A player then would be limited to his cost-of-attendance scholarship."

So a lot of athletes would not have money paid into the trust fund. Will reduce costs a lot.
Would also tend if used to use a lot, with those not used not just used once maybe.

Ruling will most likely be overturned because part of the judges ruling is based on...

These recruits have no other option other than FBS schools because of the difference in scholarships. Where she is mistaken, the number of scholarships is not the cause of the lower level of athletic competition. These recruits could all choose to go to play for FCS schools and get the same basic package (4 year scholarship) and FCS would become the more talented division.

but it really does not matter because...

one release clause added to the contract these players sign will give the schools the ability to use their likeness.

Doesn't apply to women's basketball? Why? Because men basketball players deserve to make money off of their likeness but women basketball players don't? I see issues.

Ability to cap it at $5,000? Why? If Joe's likeness is worth $100,000 what precedent allows the NCAA to take $95,000 of his worth and force him not to use the other $5,000 for some time? I see issues.

Doesn't sound like a general judgment on the law, but a narrowly tailored attempt to stop a mess but not be too revolutionary about it.
