A recap can be found at http://abclocal.go.com/wtvd/video?id=9262638

Nothing to see really.

"It could take months before a ruling is issued".

I can give you the ruling now if you like. Of course, we already know the results here in NC 03-wink

That is always the case with appellate arguments.

Sometimes, it can be more than six months before a decision is rendered.

I thought some folks might want to watch the oral argument.

I have been in enough of them to not want to watch this one.

None of it really matters. The ACC will be holding $30-$34 million from Maryland on June 30 of 2014. After that, even when the ACC wins, actually collecting on a judgment will be amazingly difficult and the NCAA is the only venue I see for that and a 10% levy against MD's NCAA money will generate only about $400 K per year.

I don't know the mechanics of collecting a judgment from a State.

I don't know the mechanics of collecting a judgment from a State.

Normally, a successful plaintiff has to get a state representative or senator to file an appropriations bill to authorize payment to the plaintiff out of the state's general fund.

We do a lot of work representing the State of Louisiana and its various agencies. That is the way it works here.

You can get a $10 billion dollar judgment against the state but if you cannot successfully lobby a bill through the legislature and get it signed by the governor, you cannot collect a nickel.

The law will not allow you to seize the state capitol, governor's mansion, state police barracks or other state property to sell it like you would to enforce a civil judgment against a private party.

Thanks Terry, that makes it all crystal clear. It makes me wonder if MD had not bargained on the ACC withholding money starting in December of 2012. It would make sense that Loh banked on a uncollectable judgment.

Hence the $30 million "travel subsidy".

Given the circumstances, if possible, Rutgers and Maryland should have bolted this year.
