Could be any of them, all of them, or none of them. Depends on the context.
At least with respect to raising/educating children, the "great arbiter" should, generally, be the child's parents and/or legal guardians, and the role of the state should, generally, be to enable the parents to fulfill that role as completely as possible.

So children should be limited to achieving only the same level of educational failure as their parents? I would hope that, for example, Torch's kids would at least be exposed to 150 years of scientific advancement that he seems to have ignored.

They "should" not be so limited; I do not wish that for them; and I don't think it would happen as often as your question implies. But so far as the state's authority is concerned -- or at least, so far as my personal belief about the proper role and function of the state's authority is concerned -- I admit that sometimes it would happen. This admission is rooted in my belief that children belong to their parents and not to the state. I realize that has become a minority viewpoint in recent years, but I still believe it.
