Future of NIT?
Pitt, Oklahoma, Indiana, Memphis, Ole Miss and St. John's opted out. Will the opt outs continue to grow?
Any NBA prospect is foolish to risk his career for the NIT.
The NCAA owns the NIT. Why not fold it and increase the NCAAT to 96 teams. Teams 33- 96 have a play-in game on campus 96 v 33, 95 v 34, etc. The winners get reseeded as 9's - 16's.

why not drop most of the NCAA teams too since we're going to open that Pandora's box... no team rated lower than an 8-seed has ever won the NCAA, so just drop all those teams (except the automatic qualifiers)

of all the teams that opted out, only pitt's carrington is expected to be a first round pick. the rest of those squads could use more games.

Make the tournie 128 teams, and kill the NIT.

Better yet...
"Kill" the NIT, the CBI, and all the other nonsensical post-season tournaments. Make the NCAA Tournament the "only" show in town.
THEN...end the "Play in Games" and bring the NCAA Tournament back down to 64. You're "in" or you're "out."
AND bring back the stipulation that "Regular Season Champs" who don't win their conference tournaments get an "guaranteed" bid to the NCAA Tournament, thereby making the NCAAT equitable again.
The "National Invitation Tournament" was the older contest, but there's no need for it anymore. For awhile there, they kept the NIT around as the "Second Tier" tournament...but that's largely gone by the wayside, especially as the NCAAT was increased from 64 to 68. Then the existence of the NIT was justified as the place where low/mid-major conference teams who won their Conference through the regular season but got bounced from their Conference Tournament wouldn't get "left out." But that's gone now too.
The NIT isn't even in MSG anymore. Teams for a variety of reasons aren't pushing it anymore. Just end it...like every other sport (minus CFB, which doesn't have a true playoff system), make the National Championship Tournament the final thing.

Bleh... horrible, horrible ideas. Just Terrible.
many of the NCAA reasons that you listed were the exact reason that the NIT existed in the first place. (i.e., getting sued for predatory practices and exclusionary practices)
Let the kid play, what is wrong with you folks? Leave them alone. If you don't want to watch, then don't.

RE: Future of NIT?
The thing I like about the NIT and the CBI is that it gives some of the "non-power" schools a chance to win a postseason title aside from a conference championship. A lot of programs have the odds stacked against them that they'll ever win the NCAA Tournament. Playing in the NIT or CBI also can help with building momentum. Two years after UCF reached the NIT Final Four, we got to the NCAA Tournament. So I don't think it's bad to keep these two tournaments around.
As far as NCAA Tournament expansion, I'd be okay with expanding the First Four into the "First Eight," getting four more bubble teams involved. But I wouldn't go further than that until seeing how that works out for a few years.

RE: Future of NIT?
I had fun watching UC play in the NIT. Indiana State is one of the 2 or 3 best offensive teams UC played all year, and maybe the hardest matchup for how we like to guard because of the way they could pull our bigs away from the basket and take advantage of our denial defense (because Avila is an elite passer to cutters.. he hit guys in tight windows).
I thought UC mostly played well and lost the game because Indiana State went scorching hot for 8 minutes in the second half, UC got sloppy with the basketball in the second half which led to some easy ISU baskets, and UC got a terrible whistle in front of their raucous crowd (which is often life on the road).
Fun game. Fun season, despite an incredible amount of tough losses, but assuming UC can keep the core of this team intact they are going to be a force to be reconned with in Big 12 play next year.

The Indiana State coach (Josh Schertz) is supposedly on our short list.

NIT should pay the players some NIL. If the players got paid, the programs would be more interested in going.

The NIT might be able to get the NIL money to do that. The CBI, though? They've hardly gotten any of their games on to regular TV. Do they have the cash to pay players?
