I'm not sure if they laid out their case the correct way, they basically laid it out as "let us play because we're super duper special"

In what way is it hurting their financial prospects, they're not getting paid...

Hopefully in the face of major lawsuits the NCAA does this to secure a small W in the eyes of some people so they stop constantly looking like the bad guys. If I were JMU I'd also bring up the eligibility waiver that got reversed for Walker and UNC seemingly *out of nowhere*.

Let me be clear, I actually want them to be allowed to play, I just think that the case they made is poor...

The key paragraph in the letter talks about the transformation committee changing the standards to join FBS since JMU's last waiver request. That's the "new information" the NCAA can point to ala the UNC Tez Walker case if it wants to just put this to bed, move on and save some face. Remember, as of this week the NCAA is potentially facing a $4.2 BILLION class action suit from former athletes. There is a good chance they just want to make the JMU thing and all the individual eligibility cases go away as quickly and easily as possible so their lawyers can work on saving the entire damn organization.

Great points, and the idea of the new standards including a bump in fee from $50,000.00 to $5,000,000.00 will do so much to ensure anyone tinkering with transition will 100% be ready so that they don't have to tell JMU no today because they don't want to break the hearts of SHSU and KSU.

If they want to use those guidelines then are they prepared to pay the $5 million fee for transition as well?

They laid out 3 arguments for their reasoning.

1. On August 1st, the NCAA completely redid the transition rules from FCS to FBS anyway, so the original format shouldn't be valid

2. They are now 9-0 and are the 2nd highest ranked team in the G5

3. Mental Health of student athletes

The 4th hidden reason is that the State of Virginia is going to file a lawsuit if the appeal fails.

Essentially the appeal is going to give the NCAA a chance to say "new circumstances have arisen" without publicly acknowledging that they'll get sued if they say no.

If their stats and performances aren't showcased, potential sponsors don't see them.
