TN gets tough against violent crime
If you're DUI and you kill a parent of a minor child you will have to pay child support for each child until they reach the age of 18 and graduate high school.


Law Takes Effect Forcing Drunk Drivers to Pay Child Support If They Kill Parent

Quote:HB 1384, also known as “Ethan’s, Hailey’s, and Bentley’s Law,” took effect Friday.

The bill is named after children whose parents were killed by drunk drivers.

Quote:That law “requires a sentencing court to order a defendant who has been convicted of vehicular homicide or aggravated vehicular homicide due to intoxication and in which the victim of the offense was the parent of a minor child to pay restitution in the form of child maintenance to each of the victim’s children until each child reaches 18 years of age and has graduated from high school.”

And if you're convicted of any of the following you'll have to do 100% of the sentence.

Quote:Vehicular homicide is also now subject to Tennessee “Truth in Sentencing” law, which took effect Friday.

It is one of eight violent crimes for which offenders in the state will now have to serve the entirety of their prison sentences.

That bill, SB 2284, which passed into law without Lee’s signature, is meant to be a deterrent for violent crime.

“It ensures criminals convicted of attempted first-degree murder, second-degree murder, vehicular homicide, aggravated vehicular homicide, especially aggravated kidnapping, especially aggravated robbery, carjacking, and especially aggravated burglary will serve 100% of their sentence undiminished by any sentence reduction credit

Sounds like a good law in theory, but how are they going to pay child support from prison?

Obviously some people that go to prison have money, but the demographics skew heavily toward poor.

Not everyone who drives DUI is destitute. Some have 401k's, pensions, investments, residual income sources, etc.

Regardless, inmates in TN do get paid for various things: Subject: INMATE PAY

Not much, but they do get paid.

I am still trying to figure out how this will work in practice. Auto policies will indemnify for compensatory damages for an accident, and one of the elements of damages is loss of future earnings. Are people going to be able to double-dip or will the insurer’s be entitled to a set-off?

How is liability going to be established, does it have to go be tried in civio court? What about in cases of comparative fault or when the non-intoxicated person caused the accident (don’t laugh, I have seen cases were a sober driver rear ends a person under the influence who was stopped at a traffic light).

Is the state going to bring in an economist to gauge the loss of earnings claim at present value? It’s not as simple as looking at last year’s tax return and multiplying by a number of years.
