Oklahoma State who has used the image since the 1920s is defending their trademark and saying that New Mexico state's Pistol Pete is rip off of their imagery.

New Mexico State says they adopted it in the 1960s but paid royalties to OSU and received blessing from Frank Easton's (the man the image is based on) Estate.

Wow. I don't see it. They look different enough to me.

Pistol Pete image looks so bow legged his toes point almost together.
Seen much better drawings of PP. Not a real big fan of Lasso Larry.
Guess next App State and WVU will get into it about name of Mountaineers.

In order to avoid the legal battle, might I suggest NMSU go with something along these lines?

This is the 2nd (maybe 3rd) time we have been sued by OSU about Pistol Pete. The image they are suing us over was used from the 1960's to 2000. We do not even use that image. Like anyone will ever confuse NMSU with OSU!

Georgia Southern went through the same thing with a trucking company called Covan.

Just using OK State logic. Wait until we don't use the logo anymore and then sue us.
