U.S. Army Major Stefan Frederick Cook, set to deploy to Afghanistan, says he shouldn’t have to go.

His reason?

Barack Obama was never eligible to be president because he wasn’t born in the United States.

Cook’s lawyer, Orly Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for his client.

In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.

Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. … simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

Cook, a reservist, received the orders mobilizing him to active duty on June 9.

According to this document, which accompanies Cook’s July 8 application for a temporary restraining order, he has been ordered to report to MacDill Air Force Base in Tampa, Fla., on Wednesday. From there, the Florida resident would go to Fort Benning before deploying overseas.

Documents show Obama was born in Hawaii in 1961, two years after it became a state.

A hearing to discuss Cook’s requests will take place in federal court here Thursday at 9:30 a.m.

SUM - - this ought to Ramp Up Obamagog not Turning Over ALL of his Birth Records once and for all.

This is an Army Major, not some Raw Recruit that just wants out - - this is a Career Officer and I believe this will get some attention - - he may lose his Oak Leaf for it, but it should cause enough of a stir, along with the California Judge's Decision to Hear a Different Case regarding the Obamagog and Birth Records silliness.

What a nice Scandal this would be and I guess they would have to reinstate Bush and Cheney until another Election be held - - Under the circumstances, I don't believe Congress could legally Appoint a POTUS.

One can only Hope, Pray, Beg, Plead, Ask a Million Times, Dream etc etc that this Usurper is Ousted POST HASTE .....

This one is going to be a weird one to follow.

I think that series of events would lead to a President Biden. And then (I'm guessing) a special election.

While I'm not holding my breath, it could get interesting.

I'm also virtually certain that had this been a constitutional challenge to the legitimacy of Bush's election (under any circumstances), most of the posters on here would be calling this guy a p*$$y, traitor, and a million other deregatory names.

Obama was sworn in by the chief justice, but Obama swore to preserve, protect and defend the Constitution of the United States. By breaking Article 2 Sect. 1, he would be guilty of a high crime. BY,By....

You know, I have not given this whole birth certificate thing any attention. I thought it was just some people who hate Obama trying to find a way to get him out of office.

But...after reading all the facts about what's gone on, combined with this story about the soldier's orders now being revoked...I'm starting to wonder.

It does beg the question....why not just release the birth certificate?

This is a real head scratcher. He has spent million NOT to prove eligibility. He could prove it for free. Why?

Where did you read that. If that were the case, revoking the order only manages to lessen the crime of not reporting.

Where did you read that. If that were the case, revoking the order only manages to lessen the crime of not reporting.

They nixed his deployment. He hasn't been released from his reserve obligation.

No one but the Major will lose their job here. Those in power get to make the rules...it's just that simple.
