TEXAS: GOV. Rick Perry reassertion of TEXAS State Rights
CONCURRENT RESOLUTION
WHEREAS, The Tenth Amendment to the Constitution of the
United States reads as follows: "The powers not delegated to the
United States by the Constitution, nor prohibited by it to the
States, are reserved to the States respectively, or to the people";
and
WHEREAS, The Tenth Amendment defines the total scope of
federal power as being that specifically granted by the
Constitution of the United States and no more; and
WHEREAS, The scope of power defined by the Tenth Amendment
means that the federal government was created by the states
specifically to be an agent of the states; and
WHEREAS, Today, in 2009, the states are demonstrably treated
as agents of the federal government; and
WHEREAS, Many federal laws are directly in violation of the
Tenth Amendment to the Constitution of the United States; and
WHEREAS, The Tenth Amendment assures that we, the people of
the United States of America and each sovereign state in the Union
of States, now have, and have always had, rights the federal
government may not usurp; and
WHEREAS, Section 4, Article IV, of the Constitution says,
"The United States shall guarantee to every State in this Union a
Republican Form of Government," and the Ninth Amendment states that
"The enumeration in the Constitution, of certain rights, shall not
be construed to deny or disparage others retained by the people";
and
WHEREAS, The United States Supreme Court has ruled in New
York v. United States, 112 S. Ct. 2408 (1992), that congress may not
simply commandeer the legislative and regulatory processes of the
states; and
WHEREAS, A number of proposals from previous administrations
and some now pending from the present administration and from
congress may further violate the Constitution of the United States;
now, therefore, be it
RESOLVED, That the 81st Legislature of the State of Texas
hereby claim sovereignty under the Tenth Amendment to the
Constitution of the United States over all powers not otherwise
enumerated and granted to the federal government by the
Constitution of the United States; and, be it further
RESOLVED, That this serve as notice and demand to the federal
government, as our agent, to cease and desist, effective
immediately, mandates that are beyond the scope of these
constitutionally delegated powers; and, be it further
RESOLVED, That all compulsory federal legislation that
directs states to comply under threat of civil or criminal
penalties or sanctions or that requires states to pass legislation
or lose federal funding be prohibited or repealed; and, be it
further
RESOLVED, That the Texas secretary of state forward official
copies of this resolution to the president of the United States, to
the speaker of the house of representatives and the president of the
senate of the United States Congress, and to all the members of the
Texas delegation to the congress with the request that this
resolution be officially entered in the Congressional Record as a
memorial to the Congress of the United States of America.-

With that being said, every state has in it's constitution, the things that are outside of the United States Constitution that they are left to govern. What if every state were to do this? It would be an excellent alternative to this secession business.

Think of ALL those things that aren't enumerated in the US Constitution that the federal government is doing right now. MOST of it should be left up to the states. As I've stated, maybe aside from Reagan, every president since FDR has ushered in their own version of socialism. ....well, Torch corrected me on that and said since Teddy Roosevelt. States aren't incompetent. They can do EVERYTHING the fed does aside from regulate interstate commerce and provide for the national defense. ....in which they're portion is just contributing.

It is what REAL Dissension is made of and shoves it up the Obama-gazoo with a Red Hot Poker in a way no other POTUS has been snubbed.

I mean not even 90 days in and he already has States Passing Legislation to either be Legally Absolved from Federal Tyranny, Black Mail, and Extortion or they will Secede from the Union.

Nothing this Absolute Powerful has been done since the 1860's.

We will either have 4 Years of Peace once this Little-god has been taken down a button hole or we will have Civil War because the Little-god will NOT BE FORSAKEN or RIDICULED in this manner.

I look for Civil War ... Dumbo Ears just won't be able to stand being Snubbed this way ....

I mean when you can Walk on Water, you can Rescind the Constitution and send in the Troops to Kick Our Asses .... you're gonna do it soon anyway .... may as well be sooner than later.

Sorry but it's the feds and liberals sucking on our tit. You missed the point of slapping the fed up side the head with this resolution.

And the fed doesn't create money and send it to states. It takes it from the states and then sends a pitence back. If a state leaves, they are the ones who will be owed a debt.

Maybe in about a million years or so it might be a slight problem.

I live in a place where I can't drive in ANY ... ANY direction over 10 miles and not drive over a different River Bridge.

There are so many Rivers, Creeks, Bayous, Lakes, Ponds, and Fresh Flow Well Water in my area, that you can not go 5 miles in any direction for anybody living here and not have to cross some sort of Bridge or Large Culvert System.

And we have been taking the salt out of water for years anyway ... what is your bleedin' point on that one ????

Off my States Coast WAS the largest Oil Field in the WORLD up until just a couple of decades ago when the OPEC explosion occurred in the Middle East.
